These Terms and Conditions (“Terms”) govern all transactions and services provided by Nexus Goldbuyer (“Company,” “we,” “us,” or “our”) to customers (“Customer,” “you,” or “your”). By engaging in any transaction with Nexus Goldbuyer, you agree to be bound by these Terms.
1. Scope of Services
Nexus Goldbuyer provides the following services:
- Purchase of gold and silver articles in various forms, including but not limited to jewellery, coins, bars, and scrap.
- Settlement of gold loans on behalf of customers with banks, NBFCs, or financial institutions, subject to verification and consent.
2. Eligibility
Customers must be 18 years of age or older.
Valid government-issued photo identification and address proof are mandatory.
The Customer must be the legal owner of the gold or silver presented or duly authorised to transact on behalf of the owner.
3. Verification & Compliance
All transactions are subject to KYC (Know Your Customer) requirements as per applicable laws.
Nexus Goldbuyer reserves the right to refuse service if documentation is incomplete, misleading, or suspected to be fraudulent.
Transactions may be reported to authorities where legally required.
4. Evaluation and Purity Testing
Gold and silver are evaluated using industry-standard testing methods, including but not limited to XRF testing, acid testing, or fire assay where applicable.
The valuation is based on:
- Purity
- Gross and net weight
- Prevailing market rates at the time of the transaction
- The Company’s assessment shall be considered final and binding.
5. Pricing & Payment
Prices offered are based on current market rates and may fluctuate.
Once the Customer agrees to the quoted price, the transaction is considered final.
Payments are made via:
- Bank transfer
- Cheque
- Other legally permitted cashless methods
- Cash payments, if any, shall strictly comply with applicable laws and limits.
6. Gold Loan Settlement Services
Nexus Goldbuyer may assist in settling outstanding gold loans with third-party lenders.
The Customer must provide:
- Loan account details
- Written authorization
- Any required consent letters
Loan settlement is subject to:
- Confirmation of outstanding dues from the lender
- Release of pledged gold by the lender
- Nexus Goldbuyer is not responsible for delays caused by banks, NBFCs, or third-party institutions.
7. Ownership & Title Warranty
The Customer warrants that:
- The gold/silver is not stolen, pledged (unless disclosed), or under dispute.
- The transaction does not violate any law.
- The Customer agrees to indemnify Nexus Goldbuyer against any claims, losses, or legal actions arising from false ownership or misrepresentation.
8. No Right of Return
Once the transaction is completed and payment is made, no return, cancellation, or reversal shall be permitted.
9. Limitation of Liability
Nexus Goldbuyer shall not be liable for:
- Market price fluctuations after transaction completion
- Delays or failures caused by third-party lenders or banks
- Indirect, incidental, or consequential losses
- The Company’s liability, if any, shall be limited to the transaction value received from the Customer.
10. Confidentiality
All customer information is treated as confidential and used solely for transaction and compliance purposes, unless disclosure is required by law.
11. Right to Refuse Service
Nexus Goldbuyer reserves the right to:
- Decline any transaction without assigning a reason
- Modify or discontinue services at its discretion, subject to legal requirements
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of West Bengal, INDIA.
Any disputes shall be subject to the exclusive jurisdiction of the courts of West Bengal, INDIA.
13. Amendments
Nexus Goldbuyer may revise these Terms at any time. Updated Terms shall be effective immediately upon publication or display at business premises.
14. Acceptance
By proceeding with any transaction, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
